29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) West Southside Avenue, Cherry Creek, NY. site, no competent person was available on site as evidence by the accumulation of water,  lack of cave-in protection, and the lack of ladder in the trench to allow employees  to gain access to and from the trench. These conditions should not have been present if a competent person was performing his assigned duties.    ABATEMENT CERTIFICATION NEEDED
