WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 330267,  CITATION NO. 1, ITEM NO. 8, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 03/13/2013, WITH RESPECT TO A WORKPLACE LOCATED AT 630 WEST SOUTHSIDE AVENUE, CHERRY CREEK, NY 14723.    29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):       a) On or about 05/06/13, in a trench/excavation on construction site in front of 216 Northcrest Avenue, Cheektowaga, NY:  An employee entered the west end of a trench that was 5 ft. 11 in. deep x approx. 3 ft. wide x 45 ft. long, and walked east on the trench bottom to signal the excavator operator who was installing a new water pipe in the trench using a sling attached to the excavator bucket. There was an existing copper water service line running crosswise in the trench, and they did not want to hit it. The north and south banks of the trench were vertical. No protective system was provided to protect the employee from a cave-in hazard.    NO ABATEMENT CERTIFICATION REQUIRED
