29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. (a) C.K. Stone, LLC, 119 South Spring Street, Aspen, CO 81611: On and before April 9, 2012, the exposing and controlling employer did not ensure that employees hauling up tools and materials through an opening approximately 2' x 2' wide on a scaffold approximately 20 feet high were protected from falling thorugh the opening by adequate fall protective measures. Condition exposed employees to fall hazards of approximately 20 feet.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below; (a) C.K. Stone, LLC, 119 South Spring Street, Aspen, CO 81611: On and before April 9, 2012, the exposing and controlling employer did not ensure that employees hauling up tools and materials through an opening on a scaffold approximately 20 feet high installed toe boards to protect employees working below from falling objects. Condition exposed employees to struck by hazards from items falling approximately 20 feet.
