29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:        Employees did not wear protective hats while working on the scaffold or on the ground below elevated workers.      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  (a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(DESCRIBE HAZARD(S) WHERE NECESSARY)        A citation was previously issued of 1926.501(b)(13) with a final order date of August 5, 2009 located at 3438 Pestalozzi Street, Saint Louis, MO for employee not using required personal fall protection equipment.  A recent inspection of the same establishment revealed a violation of 1926.501(b)(13) for employees not using required personal fall protection equipment.  Since the conditions are substantially similar a repeat violation is being issued for the violative conditions.      Employees working on the roof were not protected from falls greater than six feet to the lower level.        Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).
