29 CFR 1910.1000(c): An employee's exposure to respirable silica listed in Table Z-3 exceeded the 8-hour time weighted average limit calculated for that substance in the table: a) Harsco Infrastructure - Marion, Ohio: On or about July 12, 2012, an employee operating the Logik Cleaner was overexposed to respirable silica at an 8 hour time weighted average of 2.127 milligrams per cubic meter, which exceeded the calculated permissible exposure limit for silica of 1.409 milligrams per cubic meter by 151%.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): a) Harsco Infrastructure - Marion, Ohio: On or about July 12, 2012, the employer failed to implement engineering and/or administrative controls to control exposures to respirable silica. An employee operating the Logik Cleaner was overexposed to respirable silica at an 8 hour time weighted average of 2.127 milligrams per cubic meter, which exceeded the calculated permissible exposure limit for silica of 1.409 milligrams per cubic meter by 151%.
