29 CFR 1910.1026(d)(2)(i): The employer shall perform initial monitoring to determine the 8-hour TWA exposure for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area. Where an employer does representative sampling instead of sampling all employees in order to meet this requirement, the employer shall sample the employee(s) expected to have the highest chromium (VI) exposures. On or about April 17, 2012 and times prior thereto, at the worksite located at or near 5104 S. 34th St., Fort Smith, AR 72903, the employer did not conduct initial monitoring for chromium (VI). The amount of time employee(s) welded on stainless steel varied from once per week to daily, exposing the employee(s) to hazards associated with chromium (VI).

Each employer whose employees are exposed to MC shall perform initial exposure monitoring to determine each affected employee's exposure, except under the following conditions: On or about April 17, 2012 and times prior thereto, at the worksite located at or near 5104 S. 34th St., Fort Smith, AR 72903, employee(s) used Anchor Brand anti-spatter, which contained methylene chloride. The employer had not conducted an initial determination of the employee exposure to methylene chloride.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: On or about April 17, 2012 and times prior thereto, at the worksite located at or near 5104 S. 34th St., Fort Smith, AR 72903, the employer did not have a written hazard communication program. The employees work with hazardous chemicals such as methylene chloride and hexavalent chromium.
