29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides and railings were not provided with a toeboard where required: On or about April 18, 2012 and at times prior thereto, in the shop area of the B & M Metal Fabrication shop, the employer did not ensure that all open sides of floors and platfroms had guard rails or toe boads. This practice exposed employees to the hazard of falling to the concrete floor below.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS) (DESCRIBE HAZARD(S) WHERE NECESSARY) On or about April 18, 2012, and at times prior therto, in the shop area of the B & M Metal Fabrication Shop, points of operation of machinery were not guarded. This practice exposed the employees to amputation hazards in the following: Instance a) The hold down cylinders on the Cincinnati shear. Instance b) The punch press, the drop off side of the angle and bar stock cutters, and the flat shearing station of the Edwards ironworker.

29 CFR 1910.22(d)(1): In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official were not marked in a conspicuous place in each space to which they related: On or about April 18, 2012 and at times prior thereto, in the shop area of the B & M Metal Fabrication shop, the employer did not ensure the load rating, of the ceiling area of the office and break room, which was used for overhead storage, was affixed in a conspicuous place, in each space to which they related. This practice exposed employees to the hazard of being struck by falling objects.
