29 CFR 1910.132(a):     Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a) On or about April 10, 2012 the chain saw used to cut dunnage: The employer failed to ensure all personal protective equipment such as but not limited to chaps were used to protect the legs and body while cutting dunage which exposed employees to the hazards associated with contacting the moving blade.

29 CFR 1910.147(c)(4)(ii):     The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to Items of this section:    a) On or about April 10, 2012 and times prior, lockout procedures for the Franklyn Drill: The employer did not ensure procedures were developed and used which identified the electric main disconnect and procedure for the capacitor when employees were involved with blade change exposing them to the hazards associated with unexpected energy release.
