29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: Along Front Street in Cuyahoga Falls, Ohio: Instructions for the JRB quick coupler, which were located in the cab of the Deere 120 excavator, indicated that a second, supplementary safety action was required to secure buckets and other attachments to the quick coupler. No secondary safety action was being taken, exposing employees in the excavation to a hazard.

29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"): Appendix D of the Respiratory Protection standard, or the equivalent information, was not provided to employees voluntarily wearing 3M N95 dust masks.

An employee was exposed to silica when dry-cutting through a rock that was obstructing work in an excavation.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures: Along Front Street in Cuyahoga Falls, Ohio: Employees worked in a trench approximately 5 feet in depth that showed 2 areas where the pavement was undermined. There was no support system in place for the pavement, which was an active roadway.
