OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On January 10, 2013 employees were exposed to a fall hazard of approximately 10 feet while using the bucket of a Ford, Model 555C backhoe/loader as a work platform to untangle utility lines caught on a dump truck cab protector.

29 CFR 1926.600(a)(6)(iii): In transit with no load and boom lowered, the equipment clearance shall be a minimum of 4 feet for voltages less than 50 kV, and 10 feet for voltages over 50 kV, up to and including 345 kV, and 16 feet for voltages up to and including 750 kV; On January 10, 2013 during construction activities the employer did not ensure while moving an unloaded dump truck it maintained a minimum clearance of at least 4 feet from utility lines with voltages less than 50 kV.
