29 CFR 1926.502(k)(7): The fall protection plan shall identify each location where conventional fall protection methods cannot be used. These locations shall then be classified as controlled access zones and the employer did not comply with the criteria in paragraph (g) ofthis section. Carpenters and laborers were observed performing leading edge operations where the guardrail was not installed allowing workers to freely move into the leading edge work area exposing them to a 10 foot fall hazard, on or about 04/11/12.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) A laborer was observed without fall protection while working on top of the Conex box receiving materials from the tower crane to be placed in storage exposing him to a 9 fall hazard, on or about 04/11/12. b) A carpenter was observed without fall protection while relocating his personal fall protection anchorage point exposing him to a 10 fall hazard, on or about 04/11/12. Barr Concrete was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA Inspection # 315197269, Citation # 1, Item # 1, issued on 04/06/2011, with respect to a workplace located at 4619 41st Street, NW, Washington, DC 20016.
