29 CFR 1910.147(c)(7)(i):     The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:    The employer failed to protect employees from potential caught between, struck by, electrical and amputation hazards associated with failing to provide lockout and tag out training to employees prior to exposure.  This was most recently evident during the inspection of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees performing maintenance on equipment without having provided them lockout and/or tag out training in support of this sub part.  Instances include but are not limited to:      i.  Maintenance employees servicing and operators operating the Hitachi Seiki Mill, Model # VS50, Serial # 50074.    ii.  Maintenance employees servicing and operators operating the Milltronic Centurian 7 CNC Mill, Model# BR50, Serial # 9687.

29 CFR 1910.178(a)(4):     Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    The employer failed to protect employees from potential struck by hazards associated with operating a forklift that has a hole in the forks.  This was most recently evident during the inspection of the northwest area of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees using the green Clark forklift to move material throughout the facility, the fork lift has holes drilled in the tips of both forks and the holes do not meet the dimension criteria.  The employer has not attempted to contact or has received any written approval from the manufacturer to determine how the holes affect the capacity of the lift.

The employer failed to protect employees from potential struck by hazards associated with operating a forklift that is missing a seat belt.   This was most recently evident during the inspection of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees using the green Clark forklift and the Yale forklift to move material throughout the facility, the fork lift is missing a seat belt thus exposing the employee to potential additional injuries in the event of an accident.

The employer failed to protect employees from potential explosive hazards associated with failing to remove a truck with damaged parts from service.  This was most recently evident during the inspection of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees using the Yale forklift to move material throughout the facility and the forklift has a broken retaining strap on the propane tank.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    The employer failed to protect employees from potential amputation hazards associated with operating unguarded equipment.  This was most recently evident during the inspection of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees operating various pieces of equipment throughout the facility that are not guarded against potential amputation hazards.  Instances include but are not limited to:      i.  Missing point of operation guarding on three milling machines:         a.    Bridgeport  Drive Serial # 50266, Head # J176380.         b.    Bridgeport  Drive Serial # 114782-2, Head # J254521.         c.    Acer  Model # 8V2, Serial # 9412889.    ii.  Missing point of operation guarding on the Sears Craftsman drill press Model #113, Serial # 21370.    iii.  Missing guarding on the area to the right of the cutting area.  FMB horizontal band saw Model # TRITON, Serial # 80438.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    The employer failed to protect employees from potential chemical hazards associated with failing to provide HAZCOM training to employees prior to exposure.  This was most recently evident during the inspection of the facility located at 1216 E. 19th Street, Columbus, NE 68601, where the employer has employees using acetone as a cleaner on parts during the manufacturing process without having trained the employees in accordance with this subpart.
