Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:    a) Outside trash dumpster area.  An employee was exposed  to a fall hazard while standing on the forks of the Nissan 50 propane forklift over 8 feet above the parking lot to empty wood debris into the dumpster.     Among other methods, one feasible and acceptable means of abatement would be as follows:    1) Utilize only platforms designed for use in elevating personnel with forklifts.  These platforms must meet the requirements set forth in ANSI/ITSDF B56.1-2009 Safety Standard for Low Lift and High Lift Trucks Section 4.17 Elevating Personnel, and 7.37 Platforms: Elevating Platforms for elevating personnel shall have (a) a slip resistant floor surface, (b) a minimum floor space of 450 mm X 450 mm for each platform occupant. (c) protection for personnel in their normal working position on the platform from moving parts of the truck that represent a hazard. (d) restraining means such as a guard rail or a means for securing personnel such as a body belt or lanyard whenever the platform can be elevated to a height greater than 1 200 mm.    2) Utilize two smaller dumpsters.    3) Utilize a dumpster placed next to a raised dock area.    4) Utilize a self dumping hopper that can be used with the forklift.
