29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be nescessary to comply with the standards set forth in 29 CFR 1926.    (a) Location: Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: The employer did not implement and maintain their safety and health program through enforcement of their requirements spelled out in their written program. Subcontractors were observed working at heights without the use of fall protection systems, improper use of fall protection systems, and misusing ladders, occurred on or about 5/3/12.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: Employees of M&B Construction were setting roof trusses without the use of fall protection, an approximate 20 foot exterior fall and a 10 foot interior fall, observed on or about 5/3/2012.         (b) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: Employees of R&T Management Services were working on top of the elevator shaft without the use of fall protection, an approximate  12 foot interior fall to a concrete work surface, observed on or about 5/3/2012.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

(a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: An employee of M&B Construction was working next to a wall opening without the use of fall protection, observed on or about 5/3/12.         (b) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: An employee of Del Ciotto Architects was working next to a wall opening without the use of fall protection, observed on or about 5/3/12.     NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
