29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a)  L & M Roofing Inc. at 306 Collyer St. in Longmont, CO:  On May 3, 2012 the employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. This condition exposed employees to a fall in excess of 11 feet.    Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:    (a)  The nature of fall hazards in the work area;  (b)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  (c)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;   (d)  The role of each employee in the safety monitoring system when this system is used;  (e)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  (f)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  (g)  The role of employees in fall protection plans;  (h)  The standards contained in this subpart.  the employer did not provide training to employees regarding hazards associated with the work environment in that employees did not understand and recognize fall hazards.  This condition exposed employees to a fall hazard of approximately 11.5 feet. 29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:    (a) L & M Roofing Inc. at 306 Collyer St. in Longmont, CO:  On and before May 3, 2012, the employer did not ensure that employees were protected from injury, in that one employee staging shingles on a 10:12 pitch roof was not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 11.5 feet.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").    L & M Roofing, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 501(b)(13) which was contained in OSHA Inspection Number 314659657, Citation 1, Item 2, issued on October 14, 2010, and became Final Order on October 18, 2010 with respect to a workplace located at 15832 E. 98th Pl. in Commerce City, CO.

29 CFR 1926.95(d)(1): The protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees:    (a) L & M Roofing, Inc. at 306 Collyer St. in Longmont, CO: On and before May 3, 2012 PPE was not provided by the employer at not cost to the employees in that the employer required employees to purchase their own harnesses for fall protection or withheld the cost of the fall protection from the employees' pay.  This condition exposes employees to a fall hazard.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
