On or about May 7, 2012 and times prior thereto, employees of Maricorp U.S., LLC performed dock construction at or near 1 Yacht Club Road in Little Rock, Arkansas while working from a four-tier scaffold. The scaffold used by employees had been placed near water where the hazard of drowning existed. The employer had not provided employees with the use of a life jacket or buoyant vest.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less therafter for scaffolds greater than 3 feet (0.91m) wide. On or about May 7, 2012 and times prior thereto, employees of Maricorp U.S., LLC constructed a marina dock at or near 1 Yacht Club Road in Little Rock, Arkansas. The employees performed work activities while working on a four tier mobile scaffold. The platform height exceeded three times the base dimension. The employer had not properly restrained the scaffold from tipping by guying, bracing, or outriggers as required by the manufacturer.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about May 7, 2012 and times prior thereto, employees of Maricorp U.S., LLC constructed a marina dock at or near 1 Yacht Club Road in Little Rock, Arkansas. The employees worked from a 4-tier mobile scaffold to bolt purlins into steel columns. Employees accessed the platforms on the scaffolding by climbing the frame. The employer had not provided a ladder for employee use, exposing employees to falling hazards of approximately 20 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. On or about May 7, 2012 and times prior thereto, employees of Maricorp U.S., LLC, constructed a dock at or near 1 Yacht Club Road in Little Rock, Arkansas. Employees performed tasks such as but not limited to bolting purlins to columns while working on a scaffold. A four-tier mobile bakers scaffold had been used by employees, without the use of fall protection such as guardrails, exposing employees to a falling distance greater than 6 feet.
