29 CFR 1926.106(a): Employees working over or near water, where the danger of drowning exists, shall be provided with U.S. Coast Guard-approved life jacket or buoyant work vests. On or about July 2, 2013 and times prior thereto, employees of Maricorp U.S., LLC. performed marina dock construction at or near Riverfront Road in North Little Rock, Arkansas. Employees performed work tasks such as but not limited to decking the walking surface for the marina over the water's surface where the danger of drowning existed, without the use of U.S. Coast Guard approved life jackets or buoyant work vests.
