OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to entrapment and crush-by hazards when operting a forklift without seat belt fastened:    a) On or about May 2, 2012, and times prior thereto, at the Wild Bore Machine Shop, the employer failed to enforce seat-belt use on forklifts No. 1, 7, and 8, exposing employees to hazards not limited to ejection from the seat, and entrapment and/or crush-by injuries following a tipover.    b) On or about May 2, 2012, and times prior thereto, at the Wild Bore Machine Shop, the employer failed to provide seat belts on forklifts No. 2, 3, 4, 5, and 6, exposing employees to hazards not limited to ejection from the seat, and entrapment and/or crush-by injuries following a tipover.

29 CFR 1910.106(b)(2)(vii)(a):     Area(s) surrounding tank(s) containing flammable or combustible liquids were not provided with adequate drainage or dikes:    a)  On or about May 2, 2012, and times prior thereto, outside the Wild Bore Machine Shop, at the roadside near the forklift maintenance area, the employer failed to provide diked areas around gasoline and diesel storage tanks, to protect from unintended vehicular collision, and to retain accidental discharge, exposing employees to hazards not limited to fire and burns.    ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.178(n)(4):     Industrial truck driver(s) were not required to slow down and sound the horn at cross aisles and wherever vision was obstructed:    a) On or about May 2, 2010, and times prior thereto, at the Wild Bore Machine Shop, and around the industrial campus, forklift operators were not required to sound horns on PIT No. 1, No. 3, No. 4, and No. 7, all of which lacked functioning horns, exposing employees to struck-by and crush-by hazards.

29 CFR 1910.178(p)(1):     Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition:    On or about May 2, 2012, and times prior thereto, at the Wild Bore Machine Shop, Caterpillar forklift No. 2 was found unsafe with an inoperative horn, parking brake, and broken LPG cylinder straps, and the employer allowed it to remain in service, exposing employees to hazards not limited to struck-by, crush-by, and fire and burn hazards.
