29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    a)  Excavation Area:  A competent person was not on site to make inspections as needed throughout the shift, on or about 5/10/2012.    Abatement note:  To be a "competent person" under this standard, a person must have had training in, and be knowledgeable about, soils analysis, the use of protective systems and the requirements of this standard.

29 CFR 1926.652(c)(2)(iii):     Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the jobsite during construction of the protective system, and a copy was not made available to the Secretary upon request:    a)  Throughout Site:  The tabulated data for the Efficiency Production, Inc. hydraulic aluminum shoring was not on site and available, on or about 5/10/2012.

29 CFR 1926.652(d)(2):     Manufactured materials and equipment used for protective systems were not used and maintained in a manner that was consistent with the recommendations of the manufacturer:    a)  Excavation Area:  The Efficiency Production, Inc. hydraulic aluminum shoring, protective system, was not used in accordance with the manufacturers tabulated data, on or about 5/10/2012.    The faces of the excavation were not straight and near vertical.    The shoring members did not bear on firm soil or solid filler.   The soil was not able to stand with unsupported vertical sidewalls long enough for shoring installation.   Trenches exceeding 8 ft. in length did not have a minimum of 3 shores spaced according to the tables.
