29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. (a) On or about May 15, 2012 employees utilized a Yale powered industrial vehicle to elevate a diesel pump to approximately waist high during a pump swamp. Employees were changing piping on the new pump to match the piping in the island sump by working with their arms inside the bottom portion of the elevated load. The Yale powered industrial truck's operator was dismounted working on the pump also, leaving the lift running with the load engaged. This substandard actvity exposed employees to crushed by and struck by hazards that could result in serious injury and/or death. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l)(3)(i)[M] to include other operating instructions, warnings, or precautions listed in the operators manual: Employees were not trained on all the warnings listed in the Yale Forklift operators manual identified on pages 4 and 5 which included "ALLOW NO ONE under or near lift mechanism or load" (page 4), and "BEFORE DISMOUNTING, neutralize travel control, lower carriage, and set brake" (page 5). This substandard activity exposed employees to crush by and struck by hazards that can cause serious injury and/or death. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.
