29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). (a) On or about October 27, 2023, at the worksite located at 340 West Brown Deer Road, Bayside, WI 53217, the employer did not ensure that an adequate protective system was used in an excavation to protect employees from potential trench collapse hazards. Specifically, on the northwest end of excavation where an employee was at the edge of the excavation guiding a 20,000 gallon gas tank into position, the vertical wall of the northwest end of the trench was not protected from cave-in of soil, exposing the employee to a cave in and crushing hazard.
