29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition: Facility: On May 15, 2012, and at times prior thereto, the employer did not ensure that electric mules in need of repair were withdrawn from service. At the time of the inspection, Mule 11 was out for ready use with defects including; A. Cardboard being placed over the foot pedal, which disabled the emergency brake. B. There was no key and the electric starter had somehow been hot-wired.
