29 CFR 1926.151(a)(3): Smoking shall be prohibited at or in the vicinity of operations which constitute a fire hazard, and shall be conspicuously posted: "No Smoking or Open Flame." On or about 05/16/12, at the Strathallen Hotel, (under renovation) on 550 East Avenue, in Rochester, New York, an employee was observed smoking near hilghly flammable liquid and vapor (Weathered Membrane Cleaner and Low Voc Bonding Adhesive). NO ABATEMENT CERTIFICATION REQUIRED
