29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a)  Francisco Lopez Construction, 5246 Rangeland, Loveland, CO:  On or about May 8th, 2012, the employer had not ensured employees were provided with and using hardhats while framing a new two story single family home.  Employees working on the first floor exposed to struck by hazards associated with dropped material and/or tools while employees framed the second story.       Abatement Note:  Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) Francisco Lopez Construction, 5246 Rangeland, Loveland, CO:    On or about May 8th, 2012, the employer had not ensured employees were provided with and using an appropriate fall protection system/method while stick framing the second story of the single family residence.  Condition exposed employees to a fall hazard of approximately 10 feet.    Note: When the employer can demonstrate that it is infeasible or creates a greater hazard to use systems described above, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (K) of 29 CFR 1916.502    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the abovelisted   fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(K) for a particular workplace situation in lieu of implementing any of those systems.
