OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to hazardous conditions when working on and from a job made work platform/basket with no fall protection system in place. In addition, job made platform/basket was not properly secured to forks: a) 2 Berry Farm Road, Whitehouse Station, NJ 08889. The employer allowed his employees to work on and from a job made work platform/basket supported and elevated by a Gradall 544D-10 Rough Terrain Lull with no fall protection system in place. In addition, the job made platform/basket was not properly secured to the forks.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) On or about 05/19/12 CSHO observed an employee operating a Hitachi pneumatic nail gun while not wearing any eye and or face protection. In addition, both employees admitted during their interview they were operating a Makita circular saw while not wearing any safety glasses.
