29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces. (a) Kalmbach Feeds, Upper Sandusky, Ohio: On or about May 23, 2012, the employer did not ensure that the floors and horizontal surfaces in the North mill room were kept clean of accumulated dust from the milling of corn. A sample of the dust was determined to be explosive and a Class II material.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, or approved for the hazardous (classified) location, or safe for the hazardous (classified) location: (a) Kalmbach Feeds, Upper Sandusky, Ohio: On or about May 23, 2012, the employer did not ensure that the electrical equipment in the North mill room (corn mill) was safe to use in a hazardous location. The electrical outlet in the North mill room was NEMA Type I and not rated for a Class II, division 2 area.
