29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards. a) On or about June 5, 2015, Kalmbach Feeds, Inc. the employer failed to ensure that guard rails were in place for employees who were exposed to fall hazard while emptying grain from the top of rail cars at the rail pit. Employees were exposed to a fall hazard of greater than 8 feet.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. a) On or about June 9, 2015, Kalmbach Feeds, Inc failed to provide the employee with a medical evaluation to determine the employees ability to use a respirator. Failing to ensure employee were healthy enough to wear a respirator can lead to additional burden on the employee pulmonary function, initiating symptoms from underlying health conditions.
