29 CFR 1910.107(c)(2):  Open flame or spark producing equipment was within a spraying area and/or within 20 feet thereof, was not separated by a partition:    Spray Painting area - Lights, fans, radio, battery charger for handdrill, etc. were located within the spraying area without a partition on or about May 23, 2012.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    Employees were exposed to splash hazards when adding water to the battery of the forklift and the solution for the emergency eyewash station had not been changed since February 2012 on or about May 23, 2012.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    Motovario Corporation had not developed a written hazard communication program on or about 5/23/2012, where employees are required to work with chemicals that include, but not were not limited to paints, thinners, isocyanates, acetone, and battery acid.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1):  The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area    Motovario Corporation had not developed a written hazard communication program for employees upon assignment on or about 5/23/2012, where they were required to work with chemicals that included, but were not limited to paints, thinners, isocyanates, acetone, and battery acid. 29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a) Employees  are required to wear a 3M full face and a half mask respirator for protection while spray painting.   The employer had not developed a written respiratory protection program  on or about 05/23/12.
