29 CFR 1926.1101(f)(2)(i) Each employer who had a workplace or work operation covered by this standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation: (a) United Materials, LLC at 1050 Elizabeth St. in Denver, CO: The employer did not ensure that a "competent person" conducted an exposure assessment before or at the initiation of the project to ascertain expected employees exposures to asbestos. This condition exposed employees to an asbestos hazard. Abatement Note: The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly. Basis of Initial Exposure Assessment: Unless a negative exposure assessment has been made pursuant to paragraph (f)(2)(iii) of this section, the initial exposure assessment shall, if feasible, be based on monitoring conducted pursuant to paragraph (f)(1)(iii) of this section. The assessment shall take into consideration both the monitoring results and all observations, information or calculations which indicate employee exposure to asbestos, including any previous monitoring conducted in the workplace, or of the operations of the employer which indicate the levels of airborne asbestos likely to be encountered on the job. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.1101(k)(9)(i) The employer did not train each employee who was likely to be exposed in excess of a PEL, and each employee who performed Class I through IV asbestos operations, in accordance with the requirements of this section. (a) United Materials, LLC at 1050 Elizabeth St. in Denver, CO: On and before May 23, 2012 the employer did not train each employee who performed Class I through IV asbestos operations. On May 18, 21, and 22 untrained employees removed roofing material containing ACM. This condition exposed employees to an asbestos hazard. Abatement Note: Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.1101(o)(4)(i) For Class I and II asbestos work the competent person was not trained in all aspects of asbestos removal and handling, including: abatement, installation, removal and handling; the contents of this standard; the identification of asbestos; removal procedures, where appropriate; and other practices for reducing the hazard: (a) United Materials, LLC at 1050 Elizabeth St. in Denver, CO: For Class II asbestos work the competent person was not trained in all aspects of asbestos removal and handling. This condition exposed employees to an asbestos hazard. Abatement Note: Such training shall be obtained in a comprehensive course for supervisors that meets the criteria of EPA's Model Accredited Plan (40 CFR part 763, subpart E, Appendix C), such as a course conducted by an EPA-approved or state-approved training provider, certified by EPA or a state, or a course equivalent in stringency, content, and length. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
