29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or about May 16, 2012, and at times prior thereto, the site superintendent operating the Snorkel aerial lift was not protected from falls out of the basket while working a maximum heights of approximately 40 feet. Employer training did not adequately instruct employees on the dangers of the work and how to avoid unsafe conditions. Note: Abatement certification is required for this item.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. (a) On or about May 16, 2012, and at times prior thereto, the site superintendent operating the Snorkel aerial lift was not protected from falls out of the basket while working a maximum heights of approximately 40 feet. (b) On or about May 16, 2012, and at times prior thereto, the controlling employer, Rudeen Development, did not ensure that it's sub-contractor, Gorton Construction, while operating the adjacent JLG aerial lift, was protected from falls out of the basket while working a maximum heights of approximately 40 feet. Note: Abatement certification is required for this item.
