29 CFR 1910.147(c)(1):  The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpectedenergizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      As of 04/25/2012 the employer failed to establish an effective program for the control of hazardous energy at the facility.  Employees perform service and maintenance on equipment such as, but not limited to, the Accu-Kut: plasma laser cutter, the Piranha 88 ton, hydraulic press brake and shear, the Piranha iron worker and several automatic lathes.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:      On or before 04/25/2012 the employer did not ensure that various equipment or machinery used at the site was effectively guarded.  The unguarded equipment includes, but is not limited to:        a.   The unguarded rotating parts of an automatic lathe;    b.  The Piranha 88 ton hydraulic press;    c.   The Accu-Kut (hydef) plasma laser cutting machinery, which exposed employees to arcing and flying sparks.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:      On or before 04/25/2012 the following equipment located in the fabricating area of the facility, was not equipped with point of operation guarding:    a.  The Piranha iron worker;    b. The ingoing nip point of the Lown roll bender, located in the fabricating area of the facility.
