29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about May 3, 2012: The employees working at the facility at 215 Andrews Road building are exposed to inhalation hazards from spray painting. The employee spray painting in the paint booth wears a tight fitting 3M respirator and paints on average 3-4 days a week and uses approximately 10 gallons of paint a day. Employees have not been medically evaluated to wear tight-fitting respirators.

29 CFR 1910.134(k): The employer did not provide comprehensive, understandable training which did not occur annually and/or more often if necessary: On or about May 3, 2012: The employees working in the production areas are exposed to inhalation hazards: (a) At the 215 Andrews Road building employees are required to wear the 3M half face tight fitting respirator while spray painting flammable liquids. (b) At the 70 Banks Road building employees wear the N95 respirator voluntarily when cleaning the production area and when emptying the dust collector. The employer has not trained employees on respiratory protection.
