29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about May 30, 2012, at the worksite located at or near the I-30 Frontage Road in Bryant, Arkansas, employees working in an excavation and in the vicinity of elevated pipe did not wear head protection.  This condition exposed employees to the hazard of being struck by pipe and/or excavated materials.

29 CFR 1926.651(c)(2):     Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    On or about May 30, 2012, at the worksite located at or near the I-30 Frontage Road in Bryant, Arkansas, a safe means of egress was not provided for employee(s) working in an approximately 5 ft. wide x 20 ft. long x 5'4" deep excavation.  This condition exposed employees to the hazard of being struck by falling excavated materials and/or cave-ins from not being able to egress from the excavation.

29 CFR 1926.652(a)(1):     Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    On or about May 30, 2012, at the worksite located at or near the I-30 Frontage Road in Bryant, Arkansas, the approximately 5 ft. wide x 20 ft. long x 5'4" deep excavation that employees worked in to perform ductile iron pipe installation had vertical walls and no precautions were implemented to protect employees.  This condition exposed employees to the hazard of being struck by falling excavated materials and/or cave-ins.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated:    On or about May 30, 2012, at the worksite located at or near the I-30 Frontage Road in Bryant, Arkansas, the competent person allowed employee to enter and work in an approximately 5 ft. wide x 20 ft. long x 54 deep excavation with vertical walls, immediate egress from the excavation was not provided, and the use of head protection was not enforced.  This condition exposed employees to struck by hazards and/or cave-ins.
