29 CFR 1910.23(a)(5):     Every pit and trapdoor floor opening, infrequently used, shall be guarded by a floor opening cover of standard strength and construction. While the cover is not in place, the pit or trap opening shall be constantly attended by someone or shall be protected on all exposed sides by removable standard railings.    a.  In the Midds wheat dump building an employee was exposed to a fall hazard from a pit floor opening measuring 26 inches in width, approximately 8' in length and approximately 10' in depth.    b.  In the concrete walkway area between the concrete silos and mill building an employee was exposed to a fall hazard from a partially removed metal cover from a fit opening measuring 16 inches in width, 18 inches in length and 16' in depth.

29 CFR 1910.23(a)(10):     Where doors or gates open directly on a stairway, a platform shall be provided, and the swing of the door shall not reduce the effective width to less than 20 inches.    In the Flour Mill Building, the exit door leading out to the wooden stairway was missing a platform when the door swings outward onto the step of the stairway.

In the Mill Building a Mill Operator was exposed to a fall hazard from the second floor wooden stairway leading down to the first floor due to the lack of adequate clearance from the stair railing and the stair structure.

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    On top of the flat roof Midds building an employee was exposed to a 20' fall hazard while on the roof checking the wheat level on the Midds bin and while moving over to the edge of the building to go down the portable metal ladder to the ground.

29 CFR 1910.147(c)(4)(i):     Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.    In the Mix Building, the specific energy control procedure for the bagger which has electrical, 220 Volts AC and pneumatic 90 psi, energy sources had not been developed.

29 CFR 1910.178(g)(2):     Facilities shall be provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and for adequate ventilation for dispersal of fumes from gassing batteries.    In the Mix Room on the 1st Floor an electrical equipment battery charger for a sit down forklift and power pallet jack truck was located on the floor and was subject to damage from the forklift truck and other vehicles operating in the area.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes. 29 CFR 1910.272(g)(1)(i):     The employer shall issue a permit for entering bins, silos, or tanks unless the employer or the employer's representative (who would otherwise authorize the permit) is present during the entire operation. The permit shall certify that the precautions contained in this paragraph (1910.272(g)) have been implemented prior to employees entering bins, silos or tanks. The permit shall be kept on file until completion of the entry operations.    On or about June 13-14, 2012, a mill employee was cleaning out the remaining wheat in Bin #6 and Silo #1 and had not been issued a bin entry permit to enter the bin and silo or had the employer's representative present during the entire operation.

In completed installations, each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear.    In the Mix Building next to the Bagging Operation a two receptacle electrical outlet 110 Volt AC was missing a faceplate.

29 CFR 1910.334(a)(2)(i):     Portable cord and plug connected equipment and flexible cord sets (extension cords) shall be visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket). Cord and plug connected equipment and flexible cord sets (extension cords) which remain connected once they are put in place and are not exposed to damage need not be visually inspected until they are relocated.    Inside the door where the concrete silo screw conveyor was located, an employee was exposed to an electric hazard when an extension cord set had almost all of its outer insulation peeled off exposing the internal insulated wiring from being run from inside the door to the outside, overhead and then dropped down into a pit where it was plugged into a portable sump pump.

In the Basement of the Flour Mill Building, a vertical belt with a spoked wheel approximately three feet off the floor to a height of approximately eight feet was not enclosed with a guard conforming to standards in paragraphs (m) and (o).    H. Nagel & Son Co. was previously cited  for a violation on this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 108190, citation number 1, item 6b, which was affirmed as a final order on December 23, 2011, with respect to the workplace located at 2641 Spring Grove Ave., Cincinnati, OH 45246.

Employees were allowed to use portable fire extinguishers at the facility and had not been provided with an educational program to familarize employees with fire extinguisher use and the hazards of incipient stage fire fighting.
