Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated work platform that was not adequately secured to the lifting carriage and/or forks of a powered industrial truck:    (a)  Zimmerman Manufacturing, LLC, 125 King Court, New Holland, PA - An employee was elevated approximately 11.5 to 12 feet high with a Yale propane-powered Model GLC040AFNUAE082 forklift while standing on a wooden pallet with a metal parts bin attached to it.  The pallet was not attached to the forks of the forklift, and the pallet with the parts bin attached fell off of the forks and crushed the employee, on or about May 25, 2012.

Employees utilized the stairway in order to access the computer room on the second floor, exposing employees to a fall hazard, on or about May 31, 2012.
