Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated work platform that was not adequately secured to the lifting carriage and/or forks of a powered industrial truck: (a) ZIMMERMAN MANUFACTURING, LLC, 125 KING COURT, NEW HOLLAND, PA - An employee was elevated approximately 12 feet high with a Yale propane-powered (SN: GLC040AFNUAE082) forklift while standing in a fabricated steel work platform. The platform was not attached to the forks of the forklift, thereby exposing employee(s) to possible injury from the platform falling from the forks, on or about April 26, 2013, and at times prior. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. ZIMMERMAN MANUFACTURING LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, OSH ACT of 1970 SECTION (5)(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 453098, CITATION NUMBER 1 ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 6, 2013 WITH RESPECT TO A WORKPLACE LOCATED AT 125 KING COURT, NEW HOLLAND, PA 17557.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: (a) PRODUCTION FLOOR - Employees used a fabricated steel man-basket on the front of a Yale propane-powered forklift(SN: GLC040AFNUAE082), and did not identify the maximum capacity and elevation at which the basket could be used, thereby exposing employees to fall hazards of approximately twelve (12) feet, on or about April 26, 2013, and at times prior. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
