OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazards from standing on top of a suspended load that was being lifted by an excavator. On or about June 5, 2012 - at the above addressed jobsite, an employee was "riding" on top of a concrete manhole cover suspended approximately nine (9) feet above the ground by a KOMATSU PC 300 LC hydraulic excavator. The employee was thereby exposed to fall hazards from inadvertent operation and movement.

29 CFR 1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service. On or about June 5, 2012 - at the above addressed jobsite, the employer did not ensure that the hook for the under-hung attachment on the KOMATSU PC 300 LC hydraulic excavator which had a concrete manhole cover suspended approximately nine (9) feet above the ground was equipped with a safety latch, thereby exposing the employees to struck by hazards.
