29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: On or about November 27, 2012 - at a jobsite located at 79th & South Shore Drive, Chicago, IL - an employee performing sewer activities in a trench/excavation measuring approximately five (5) feet three (3) inches in depth were exposed to cave-in hazards due to the lack of cave-in-protection. The Capitol Cement Company, Inc. was previously cited for a violation for this Occupational Safety and Health Standard or its equivalent Standard, 29 CFR 1926.652(a)(1), which was contained in OSHA Inspection Number 312595663, Citation Number 1 Item Number 2 and was affirmed as final order on August 19, 2009 with respect to the workplace located at Lake & Damen Avenue, Chicago, IL 60612.
