If such hazards are present, or likely to be present, the employer shall: a. On or about June 7, 2012, in the facility, employees were required to work with compressed air and hazardous chemicals, including but not limited to alkylphenol, toluene and aluminum oxide. The employer failed to perform a hazard assessment to determine which hazards were present which necessitated the use of personal protective equipment (PPE).

29 CFR 1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following: a. On or about June 7, 2012, in the facility, employees were required to work with compressed air and hazardous chemicals, including but not limited to alkylphenol, toluene and aluminum oxide. The employer failed to provide training to employees required to use appropriate personal protective equipment (ppe).

29 CFR 1910.132(h)(1): Except as provided by paragraphs (h)(2) through (h)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, shall be provided by the employer at no cost to employees. a. On or about June 7, 2012, in the facility, employees were required to work with compressed air and hazardous chemicals, including but not limited to alkylphenol, toluene and aluminum oxide. The employer did not provide adequate PPE at no cost to employees. Employees were required to purchase PPE for use in the facility when exposed to hazards which necessitated the use of PPE.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a. On or about June 7, 2012, in the facility, employees were required to work with compressed air and hazardous chemicals, including but not limited to alkylphenol, toluene and aluminum oxide. The employer did not provide training on the hazards associated with the chemicals.
