29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) Tafuna Road, excavation across from the Army PX Store: On or about 30 APR 12, workers were observed in the 4 by 10 foot wide trench without hard hat exposing the workers to impact and overhead hazards.     (b) Tafuna Road, excavation across from the Army PX Store: On or about 3 MAY 12,  a worker moving the wet cement from the truck to the trench and two other workers in the trench were not using hard hat exposing the workers to impact and overhead hazards.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) Tafuna Road, excavation across from the Army PX Store: On or about 30 APR 12, workers were observed in the 4 by 10 foot wide trench without eye protection exposing the workers to impact hazards and eye injuries.     b) Tafuna Road, excavation across from the Army PX Store: On or about 3 MAY 12, a worker shoveling wet cement from the truck and two other workers receiving the cement while in the trench were not using eye protection exposing the workers to impact hazards and eye injuries.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a)  Tafuna Road, excavation across from the Army PX Store: On or about 3 MAY 12, workers were observed in the 4 by 10 foot wide trench using a step ladder with the spreader in the closed position while ascending and descending from the trench. The workers were walking and jumping off the ladder without holding to the side rails. The ladder was not extended at least 3 feet above the landing and it was not tie off or secure, exposing the workers to falling off the ladder.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:    (a) Tafuna Road, excavation across from the Army PX Store: On or about 3 MAY 12, workers were observed using the step ladder improperly and in an unsafe manner. The workers were using a step ladder with the spreader in the closed position while ascending and descending from the trench. The workers were walking and jumping off the ladder without holding on or using the side rails. The ladder was not extended at least 3 feet above the landing and it was not tie off or secure, exposing the workers to falling off the ladder. The workers were not trained in the proper use of ladders by a competent person.
