29 CFR 1926.303(c)(3): All other portable abrasive wheels used for external grinding, were not provided with safety guards (protection hoods) meeting the requirements of paragraph (c)(5) of this section: (a) At the project on or about June 12, 2012, and at times prior thereto, there was no guard for the 4 inch diameter abrasive wheel on a 110 VAC DeWalt right angle grinder. The grinder was used to cut electrical PVC pipe.

29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: (a) At the project on or about June 12, 2012, and at times prior thereto, there was no assured equipment grounding conductor program or ground-fault circuit-interrupter protection for employees that used a 110 VAC DeWalt right angle grinder, powered through an extension cord.
