29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) In the Porous Plastics Department, the employee unloading the IR-1 was exposed to noise levels at 72.26% of the action level dose (8-hour time weighted average sound level of 85 decibels) or an equivalent sound level of 87.66 dBA during 456 minute sampling period on July 25, 2012, exposing the employee to noise induced hearing loss.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: (a) In the Molding Department, Twister Department, and Porous Plastics Department - The employer did not perform an 8 hour time weighted average dosimetry when noise levels indicated that the departments exceeded 85 dBA, OSHA's action level for noise, exposing employees to ringing of the ears.
