Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification.    a)  Second Floor - An unapproved, power strip/tap with six outlets, was used by employees to provide power to electrical power tools either directly or through portable extension cords.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection.    a)  Throughout the Site - Receptacles outlets were not protected with ground fault circuit interrupters.  Workers had used the outlets to provide power to their electrical power tools; e.g., Dewalt 304P and Milwaukee reciprocating saws.

29 CFR 1926.405(b)(2): In energized installations, each outlet box did not have a cover, faceplate, or fixture canopy:    a)  Throughout the Site - Employees were plugged into energized outlets were not equipped with a face plate to guard from accidental contact of the energized conductors.

29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)    a)  Rear/Southside of the Building - Employee were not protected by a personal fall arrest system while working on a low-slope roof exposing him to a 40 foot fall to ground level.    b)  1st, 2nd & 3rd Floors - Employees were exposed to a fall hazard while using the stairs or accessing them; the lower area of the stairs and the actual stair area are not guarded by a rail system that would prevent employees from falling to the lower level nor have hand rails been installed.     c)  1st, 2nd & 3rd Floors - Employees were exposed to open floor openings on the first, second and third floor where a future chimney would be installed.

29 CFR 1926.1053(b)(4):  Ladder(s) were used for purposes other than the purpose for which they were designed:    a)  Third Floor South/Rear Area of Site - Employees were using a step ladder in the closed position to access the roof area off the third flloor deck area.  Employees were exposed to a fall from elevation of approximately 11ft to the lower level.
