OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about June 13, 2012, at the worksite located at 100 Crestwood Drive in Beebe, Arkansas, north side of Building 900, filler blocks were not inserted between rungs on the wooden job-made ladder being used by employees to access and descend the 2nd level balcony area. Employees were exposed up to an approximately 8 ft. fall from ladder to ground below.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level: On or about June 13, 2012, at the worksite located at 100 Crestwood Drive in Beebe, Arkansas, east side of Building 900, standard guardrailing was not provided across the approximately 142 opening on the front of the elevated man basket that employees of subcontractor, Avila Framing, LLC, worked from to attach siding to the exterior of the building. Employees were exposed to falling from the man basket approximately 9-10 ft. to ground level below.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: On or about June 13, 2012, at the worksite located at 100 Crestwood Drive in Beebe, Arkansas, east side of Building 900, the approximately 72" wide x 142" long x 72" high elevated man basket attached to Skytrak 6036 that was being used by employees of subcontractor, Avila Framing LLC, to attach siding to the exterior of the building, was not approved for use by the manufacturer. This condiiton exposed employees to tip-over and an approximately 9-10 ft. fall from elevation.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system: On or about June 13, 2012, at the worksite located at 100 Crestwood Drive in Beebe, Arkansas, southeast end of Building 1100, employees working on an approximately 4:12 pitched roof rolling out and placing down felt did not wear fall protection and were not protected from falling to lower level. Employees were exposed to an approximately 17 feet fall from elevation.
