29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  At the construction site located at 1904 Epicurean Dr. in Clinton, MO., employees were exposed to a struck by hazard in that they were not protected from excavated materials that posed a hazard of rolling into the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  At the jobsite located at 1904 Epicurean Dr. in Clinton, Missouri:  Employees engaged in work in an excavation were exposed to a struck by hazard.  The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in the excavation were protected from excavation wall failure. The trench was approximately 11feet in depth, and approximately 3 feet wide.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  At the construction site located at 1904 Epicurean Dr. in Clinton, MO employees were exposed to caught in injuries, in that the ladder provided for egress from the trench employees were working in did not extend at least 3 feet above the top of the 11 foot trench.
