29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly: (a) On and before September 1, 2011, the employer modified the forklift with an attachment for maneuvering granite slabs without the written approval from the manufacturer and did not change the associated forklift tag to indicate the change in capacity. This condition exposes employees to struck-by and crushing hazards. 29 CFR 1910.178(l)(6): Employer did not certify that each operator has been trained and evaluated as required by paragraph (l) of this standard: (a) CFI, LLC at 5561 Magnolia Street, Commerce City, CO 80022: On and before September 1, 2011, the employer did not certify that each operator had been trained and evaluated to operate the forklift. Employees operate a Clark forklift to transport granite slabs from delivery trucks to storage racks and from storage racks to the fabrication shop. 29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): (a) CFI, LLC at 5561 Magnolia Street, Commerce City, CO 80022: On and before September 1, 2011, the employer did not ensure that the required workplace hazard assessment has been performed for the fabrication shop. Employees conduct operations such as, but not limited to, sawing, polishing, and slab handling. This condition potentially exposes employees to hazards such as, but not limited to, lacerations, noise, struck-by, and crushing hazards. Abatement Note: The employer shall verify that the required workplace assessment has been performed through a written certification that shall identify the following: 1. The workplace evaluated; 2. The person certifying that the evaluation has been performed; 3. The date(s) of the hazard assessment; and 4. The document as a certification of hazard assessment. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
