OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, while working under and/or near the automotive lift at Sehman Tire Service, Inc., employees were exposed to struck-by hazards:    a)  On or about June 13, 2012, daily and/or routine inspection procedures were not established to identify defects, such as but not limited to, the structural components including welds, in the electrical components and wiring, and in the lift controls including operation of the positive stop and the lifts locks for the John Bean automotive lift;    b)  On or about June 13, 2012, lift inspections of the John Bean automotive lift were not conducted at least annually by a qualified inspector.     c)  On or about June 13, 2012, periodic, planned maintenance procedures were not established for the John Bean automotive lift.

29 CFR 1910.23(c)(1):     Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing on all open sides:    a)  workplace at 11 East Corydon Street, Bradford, PA, floor of freight elevator where tires are stored.  On or about June 13, 2012, employees were exposed to falls when storing and/or retrieving tires while climbing onto the floor of the partially raised, inoperable freight elevator, 5.5 feet above the shop floor.  The open-sided floor of the elevator was not guarded by a standard guardrail.

29 CFR 1910.24(b):     Fixed stairs were not provided for access from one structure level to another where operations necessitated regular travel between levels:     a)  workplace at 11 East Corydon Street, Bradford, PA, floor of freight elevator where tires are stored.  On or about June 13, 2012, stairs were not provided for employees who had to store and retrieve tires from the inoperable, partially raised freight elevator and second floor warehouse.  Employees were exposed to falls 5.5 feet to the shop floor.
