29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Upper Level, NE Side - employees of JC Builders were working at heights of 10 - 40 feet without a personal fall arrest system in place to protect them from falling while pulling the rafters to the top floor. One employee was observed working off the beams and and top plate, exposing himself to a 40 foot fall to ground level. b) Upper Level, NE Side - an employee was located on the top floor hanging out the wall opening while pulling the rafter up; exposing himself to a fall to ground level of 20 feet. c) Upper Level, SE Corner - an employee was observed hanging out the building to help place the rafter at its designated exposing himself to 20 foot fall to ground. The same employee would be pulling the rafters near a floor opening exposing himself to 10 foot fall to the lower level.
