29 CFR 1926.20(b)(3):     The use of any Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and such Machinery, tool(s), material(s), or equipment  was neither identified as unsafe by tagging, or locking the controls to render them inoperable, nor were they physically removed from its place of operation:    a) On or about 6/19/12, on the second floor in Area A, at Construction site, 77 Goodell St., Buffalo, NY:  The employer owned a large portable fan and brought it to the jobsite on the morning of 6/19/12 from the employer's shop. The fan was to be used for ventilation. The original plug on the cord of the fan had been replaced with a 2-prong plug instead of a 3-prong grounding type plug. The employer did not perform an inspection of the fan to ensure that it was in safe   operating condition. The fan was in the area where it was to be used, and anyone could have plugged it in and turned it on.      NO ABATEMENT CERTIFICATION REQUIRED
