29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee(s) ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) On 6/19/2012 La Marche Mfg. Co. did not provide a fit test for employees required to wear 3M half mask, air purifying respirators equipped with organic vapor cartridges.  Employees are required to wear respirators in the silkscreening and welding areas.      No abatement certification or documentation is required for this item.

29 CFR 1910.1025(h)(1):     All surfaces were not maintained as free as practicable of accumulations of lead:    a) La Marche Mfg. Co. did not ensure work surfaces in the wave soldering area were not maintained to prevent lead accumulation.  On 6/19/2012, employee(s) were exposed in their workplace to lead resulting from finishing work after wave soldering.  Wipe samples of work station surfaces measured lead concentrations of 92.5 and 158 micrograms.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

Co. did not include the following chemicals in its list of hazardous chemicals: Bellman-Melcor Tin-Lead combination solder or Kester 5744 Solder Saver (borate tetrafluoropotassium, borate tetrafluoroammonium) used in the wave soldering area.
